According to the Florida Wrongful Death Act, it is the public policy of the state to shift the resulting losses from the survivors of the decedent to the wrongdoer when wrongful death occurs. The damages may be awarded as listed in the Florida Wrongful Death Act.
Florida and federal law limits the amount of financial recovery available to the loved ones of victims of accidental deaths. For instance, wrongful death statutes limit the ability of parents to bring a wrongful death claim for adult children. For all claims related to the accidental loss of a loved one, Florida law requires that a claim be filed within two years of the date of the accident.
