Have you heard the recent news about the VA and sending C&P examination reports to claimants?

In a Veteran's Disability Case, according to 38 U.S.C. 5103A, the Secretary of the Department of Veteran's Affairs shall make reasonable efforts to assist a Veteran in obtaining evidence necessary to support their claim. This Duty to Assist includes but is not limited to providing the information required to receive benefits, obtain service records, request VA treatment records, and schedule compensation and pension examinations (C&P exams). However, in the recent case Martinez v. Wilkie, the court held the Secretary's Duty to Assist did not require the VA to automatically provide a copy of a C&P Exam to the Veteran. We recommend you always request a copy of your C&P Exams!
